TERMS AND CONDITIONS OF SERVICE<\/h1>

1. Service Provider Identification<\/strong><\/h3>

These Terms and Conditions govern the contracting of tandem paragliding recreational flight services offered by SKYLANZ, the trade name of Jos\u00e9 David Gonz\u00e1lez Camacho, Tax ID 78.543.922-A, with address at Camino El Callao I, n\u00ba 28, 35571, T\u00edas, Las Palmas (Canary Islands), email skylanzparagliding@gmail.com and phone +34 627 886 301.<\/p>

2. Purpose and Scope of Application<\/strong><\/h3>

These Terms and Conditions regulate the contractual relationship between SKYLANZ and the client arising from the contracting of any of the services available on www.skylanzparagliding.com. Making a reservation or paying any amount implies full and express acceptance of these conditions in the version published at the time of contracting. <\/p>

3. Service Description<\/strong><\/h3>

SKYLANZ offers three types of tandem paragliding recreational flights called ESSENTIAL, ADVANCE, and EXPLORER, whose contents, prices, and requirements are detailed in the product sheets on www.skylanzparagliding.com, which form an integral part of these Terms and Conditions.<\/p>

Flight times and the type of experience are indicative and subject to weather conditions and the pilot’s safety decisions. If these circumstances prevent the experience from being offered under the planned conditions, SKYLANZ may, at its discretion, offer to reschedule the flight or apply a discount equivalent to the reduction in experience, without this generating an automatic right to a full refund except in the cases of section 10. <\/p>

4. Prices<\/strong><\/h3>

The prices published on the Website are final prices and include all applicable taxes. SKYLANZ reserves the right to modify them at any time, always respecting the price agreed upon for confirmed bookings. <\/p>

5. Booking and Payment Process<\/strong><\/h3>

The contract is formalized at the moment of full or partial payment for the selected service. The client will receive email confirmation once the payment has been processed. Available options are: <\/p>

  • Full payment: full amount paid at the time of booking.<\/li>
  • Payment with deposit: 25% paid at the time of booking, with the remainder settled before the start of the activity.<\/li><\/ul>

    Payment data is processed by Stripe and Redsys. SKYLANZ does not store bank or card data on its systems. <\/p>

    6. Vouchers and Gift Certificates<\/strong><\/h3>

    Vouchers are valid for 12 months from the date of purchase, are transferable, and can be used by anyone who meets the requirements of the contracted modality. The holder must contact SKYLANZ to arrange the date within the validity period. Expired vouchers will not entitle the holder to a refund or extension. <\/p>

    7. Flight Zone and Conditions<\/strong><\/h3>

    SKYLANZ reserves the right to determine the takeoff and landing zone based on safety criteria and weather conditions, a decision that is the exclusive responsibility of the pilot and cannot be subject to complaint.<\/p>

    If conditions at the agreed meeting point do not allow the activity to take place, SKYLANZ may move the service to an alternative area. Transportation will be at the client’s expense, unless they arrived in a company vehicle. If during the flight the pilot is forced to land at a different point than the takeoff, SKYLANZ will assume the client’s transfer back to the initial area. <\/p>

    8. Equipment and Safety<\/strong><\/h3>

    The use of equipment provided by SKYLANZ\u2014approved helmet and passenger harness\u2014is mandatory and will be adjusted by the pilot before the flight. Personal equipment is not allowed without the express authorization of the pilot. <\/p>

    The client must follow the pilot’s instructions at all times, whose decisions are binding for safety reasons. Non-compliance may result in immediate cancellation without the right to a refund. The use of cameras, selfie sticks, or other personal items during the flight is at all times subject to the pilot’s decision, who may permit or prohibit it depending on the flight’s safety conditions. <\/p>

    9. Passenger Requirements and Fitness Declaration<\/strong><\/h3>

    The client is obliged to inform SKYLANZ of any relevant medical condition that may affect their safety, including pregnancy, cardiovascular diseases, hypertension, anxiety, vertigo, or recent injuries, and declares not to be under the influence of alcohol, drugs, or medication that may affect their abilities at the time of the activity.<\/p>

    Failure to comply with this obligation, as well as any falsehood or inaccuracy in the declaration, exempts SKYLANZ from any liability arising from damages that may occur as a direct consequence of such omission.<\/p>

    SKYLANZ reserves the right to cancel the activity if, in the pilot’s judgment, the client’s physical or mental state poses a risk to flight safety, without any refund being due if the cause is attributable to the client.<\/p>

    Minors under 18 must have express authorization from their parents or guardians, evidenced by the parental consent checkbox in the booking process, and be accompanied by a responsible adult on the day of the activity.<\/p>

    10. Cancellations and Modifications<\/strong><\/h3>

    10.1 Cancellation by the client<\/strong><\/h4>
    • More than 24 hours in advance: 100% refund.<\/li>
    • Less than 24 hours: up to 50% of the booking amount may be retained.<\/li>
    • No-show without notice: total loss of the amount paid, with no refund or rescheduling.<\/li><\/ul>

      10.2 Cancellation by SKYLANZ<\/strong><\/h4>

      Due to weather or safety reasons, SKYLANZ may cancel the activity without generating a right to compensation. The client may choose between rescheduling or a 100% refund of the amount paid. <\/p>

      10.3 Modifications by the client<\/strong><\/h4>

      The client may request a date change with a minimum of 24 hours’ notice, subject to availability and without additional cost. With less than 24 hours’ notice, the penalties in section 10.1 may apply. <\/p>

      11. Right of Withdrawal<\/strong><\/h3>

      In accordance with article 103 l) of Royal Legislative Decree 1\/2007 (LGDCU), the 14-day right of withdrawal is not applicable once the specific flight date has been set, with only the cancellation policy in section 10 being applicable. Prior to setting a date, the client has the legal period of 14 days from contracting to withdraw without penalty and with a full refund. <\/p>

      12. Liability<\/strong><\/h3>

      Tandem paragliding involves risks inherent to outdoor sports activities that the client voluntarily assumes. SKYLANZ has civil liability and accident insurance for passengers covering the activities performed, with its liability limited to the coverage of said policy. <\/p>

      SKYLANZ will not be liable for damages arising from the client’s non-compliance with fitness requirements, concealment of health conditions, non-compliance with pilot instructions, or force majeure circumstances, nor for the loss or damage of the client’s personal belongings during the activity.<\/p>

      13. Audiovisual Material and Image Rights<\/strong><\/h3>

      Photographic and video material generated during the activity will be delivered to the client in the flight area. The client authorizes SKYLANZ to use it for promotional purposes on social media and other channels, unless otherwise indicated before the start of the activity. Subsequently, the client may at any time request the removal of their images by writing to skylanzparagliding@gmail.com, and they will be removed as soon as possible. No material featuring minors will be published without the express authorization of their parents or guardians. <\/p>

      14. Respect for the Natural Environment<\/strong><\/h3>

      The client and their companions commit to respecting the natural environment in which the activity takes place and to follow the pilot’s instructions at all times in takeoff, flight, and landing areas.<\/p>

      15. Complaints<\/strong><\/h3>

      SKYLANZ has complaint forms available to its clients. For any complaint or incident, the client can contact skylanzparagliding@gmail.com or +34 627 886 301. SKYLANZ will respond within a maximum of 30 days. <\/p>

      16. Applicable Law and Jurisdiction<\/strong><\/h3>

      These Terms and Conditions are governed by Spanish law. For any dispute, the parties submit to the jurisdiction of the Courts and Tribunals of the client’s domicile, in accordance with consumer protection regulations. <\/p>

      17. Modification of Conditions<\/strong><\/h3>

      SKYLANZ reserves the right to modify these Terms and Conditions at any time. The current version will always be the one published on the Website at the time of contracting. <\/p>
